California lawmakers to hear bill that would decriminalize welfare fraud under $25K

A draft law that criminalizes fraud on social welfare is paid less than $ 25,000 in California in search of simple administrative errors by the Democratic legislator.

Al -senator Lula Smulwood Couvas presented the Senate Law 560, which would delete criminal sanctions against social welfare to less than $ 25,000, and delete a clause for criminal penalties for any attempt to provide social welfare less than $ 950, according to the legislation, which was presented in February.

“The safety network in California should raise families, not their trap in poverty,” Smulwood Cuaves told Fox News Digital. “At the present time, the error of the deadline or the papers can lead to a felony of tearing families – even when there is no intention to deceive.”

The legislator said that the draft law “provides an intelligent and more humane approach by allowing provinces to resolve most of the cases of administratively extra payments, and accountable people without criminalizing poverty.”

The legislation was set for a session on May 5.

The draft law will require the provincial agency to determine whether the advantages of social welfare have been declared as a result of a state -level automatic care system (Calsaws).

A person is prohibited from being subjected to criminal prosecution in certain cases in order to pay excess or excessive benefits, according to the draft law.

“This is the draft law about the prevention of families from the criminal justice system from committing administrative mistakes in raising the threshold of fraud in social welfare,” said Smallwood Kevas in a publication on April 8.

Most of the fraud in social welfare occurs when the absent parent is already reported at home, and an inappropriate income, using an inappropriate child or children who do not live at home who are part of the recipient case, according to the California Ministry of Social Services.

In Los Angeles Province, field investigators deal between 15,000 to 20,000 cases or referrals, according to the Ministry of Public Social Services.

Annually, investigators find fraud in about 5,000 to 8,000 cases. From this, 200 cases are sent to the Public Prosecutor’s Office for the Los Angeles Province, and 95 % lead to condemnation.
