Judge won’t lift order requiring return of Venezuelan migrant deported under Trump policy

On Tuesday, a federal judge refused to change its order that requires the Trump administration to return the asylum seeker in Venezuelan, 20, who was deported to El Salvador, citing the protection of due legal procedures.

At a hearing on Tuesday in Baltimore, American boycott judge Stephanie Gallagr, one of the appointed Trump, rejected the government to amend its previous ruling that ordered the government to return Daniel Lausano-Gamarto, Venezuelan, who is 20 years old, to the American soil.

But she also agreed to stop the ruling for 48 hours – enough time for the government to ask the fourth circle to take the case.

If the court retracted, Gallaghar said that it will amend its decision to set an official schedule for the government to return the 20 -year -old immigrant to the United States.

Gallaghar said that this decision “attracts the correct balance between granting the government the ability” to appeal to the Supreme Court as they see appropriate – and the plaintiffs are also allowed to search for legal procedures in US courts.

Lozano-Camargo, previously referred to in court documents called “Cristian”, was deported to El Salvador in March under the early wave of the Trump administration of foreign enemies.

Gallaghar spent in April that the government violated a 2024 settlement between the Ministry of National Security and a group of young asylum seekers, including Lozano-Camargo. Under this deal, the Ministry of National Security agreed not to deport immigrants – all of whom entered as children who are not accompanied – until their cases are fully heard in court.

Last month, Gallaghar said that the deportation of Lausano Camarago was a “violation of the contract”, as his asylum issue has not yet been heard, and the US government ordered to facilitate his release.

Gallaghar repeated her previous decision on Tuesday. He also emphasized that it has nothing to do with its asylum application, referring to clear low -level drug crimes and condemnation in January. She said about allowing him to operate under the law, and under the settlement that was struck with DHS.

She said that the settlement agreement “requires him to be here and to hear it.”

Gallaghar indicated that his removal without a ruling in an American court “governs the result”, with his lawyer’s inability to challenge the case in the court.

The Trump administration told the court that it decided that Lozano-Camargo was qualified to remove under the Law of Foreign Enemies, citing his arrest earlier and convicted of cocaine possessing Houston this year.

On Monday, the lawyers of the administration told the court that his appointment was “a foreign enemy, according to AEA, stopping to be a member” in the chapter that negotiated a settlement.

At the hearing on Tuesday, Gallagher explained that her decision was based only on protecting the due legal procedures.

She said that the government “measures the benefit of using the wrong criterion” in this case, adding that it is not a situation about whether Lozano-Camargo will eventually get asylum-it is a practical issue.

She said that the process is important for various reasons – noting that even when the results appear in some criminal cases or trials clear, individuals are still entitled to be tried under American law.

The administration’s call to the fourth district, if it chooses to present it, is due on Thursday afternoon.
