President Donald Trump said on Friday that anyone burning the American flag “will be arrested immediately” and faces a single year’s prison sentence, citing his executive order on August 25 for the desecration of the flag.

“With regard to ice, border patrol, law enforcement, and all the American army: According to an executive order on August 25, 2025, please know that from this point forward, anyone who burns the American flag for one year will be in prison,” and Trump published on Friday evening.

“You will be arrested immediately. Thank you for your interest in this issue!”

The same executive order stopped creating new sanctions, and directing the Ministry of Justice to determine the priorities of cases under the current laws “to the maximum extent permitted by the constitution.”

The rulings of the Supreme Court in Texas decided against Johnson (1989) and UNIDISSS. Eichman (1990) that burning science is protected. Trump’s statement goes further, which leads to possible legal battles if arrest is pursued.

Trump has long pushed to punish the desecration of the flag, and the latest publication that sharpens his legal mission and order with the continued closure of the government.

“President Trump will not allow the American flag, a special symbol of the greatness of our country, as a tool for incitement to violence and riots that offer the safety of ordinary Americans,” White House spokeswoman Abigel Jackson told Fox News Digital. “President Trump will always protect the first amendment, while simultaneously implements logical participation policies, the crime to prevent violence and chaos.”
