Anti-Israel activist Khalil should remain in Louisiana immigration jail: DOJ

Lawyers of the Ministry of Justice asked a federal judge on Tuesday that the request of the anti -Israel activist Mahmoud Khalil refused to be released or transferred from the immigration detention center in Louisiana to one in New Jersey.

Government lawyers said that the courts do not have the authority to interfere in the decision of the executive authority with non -citizen detention in the removal procedures.

They wrote: “congress authorized the detention of foreigners and gave the executive discretionary power in this regard.”

Lawyers also said that from the logistical point of view, the Trump administration could not transfer Khalil even if it wanted it. Khalil had asked a judge on Monday to release him from the detention of ice in Gina, Louisiana, on bail while his case or transfer to Elizabeth, New Jersey, attached, is closer to his wife, the new and legal baby.

The lawyers of the Ministry of Justice were martyred with the certificate of the ICE official, who revealed that the ice facility in Elizabeth had 355 detainees, which means that it was more than 51 people.

Lawyers wrote, “The ice retains a discretionary power to detain Khalil, where he chooses,” Lawyers wrote. “In addition, real considerations are a lawyer against the transfer of Khalil to Elizabeth. Simply, the facility is more than its capacity.”

Khalil, a permanent legal resident, was arrested in March outside his apartment at the University of Colombia. The immigration judge considered him a removal based on a memorandum of Foreign Minister Marco Rubio that Khalil’s activity against Israel on the campus is inconsistent with the interests of the foreign policy of the United States. Rubio was rarely martyred from the immigration and nationality law to justify his discovery.

The Khalil case acquired a tremendous interest from the advocates of the first amendment, who argued that the government is deceiving freedom of expression by nullifying the green card to non -citizens who oppose the Israeli government with an explicit rule and irrigate it in its attack in the Gaza tape and contradict Iran.
