Court blocks Trump use of 1798 law for Venezuelan gang deportations

A federal appeal court ruled on Tuesday that the Trump administration could not accelerate the deportation of migrants accused of being members of the Venezuelan gang, Treen de Aragoa, using the war law in the eighteenth century.

In the ruling of 2-1, the Fifth Court of Appeal in the American Department sided with the lawyer of the immigrant rights and the minimum court judges who argued that the 1798 foreign enemies law was not created for use against gangs such as Trin de Aragoa.

“The Use of the Trump administration of the war in wartime during the ladder period to regulate immigration has been truly closed by the court,” said Lee Gilrrent, who argued in the American Civil Liberties Union case. “This is a very important decision in the administration’s view that it can simply announce the state of emergency without any supervision by the courts.”

The law of foreign enemies was previously used only three times in the history of the United States, all of them came during the declared wars in the 1812 war and the two world wars.

The Trump administration has claimed that the courts could not guess the president’s design that Treen de Aragoa was linked to the Venezuela government and represented a threat to the United States, in which he argued that justified the use of the law.

The administration deported the members of Trin de Aragoa to a huge prison in El Salvador, where, officials argued that the American courts were unable to request their release.

More than 250 immigrants who were deported to Venezuela returned under a deal announced in July.

In the ruling of 2-1, the court granted the first al-Zarji order that the prosecutors requested because they “did not find any predatory invasion or incursion” in this case.

The majority said that Trump’s allegations about Trine de Aragoa did not meet the historical levels of the national conflict that was planning congress when approved by law.

“A country encourages its residents and its citizens to enter this country illegally, not equivalent in the modern era to send an armed and organized force to operate, or to harm the United States,” said Leslie Southok and Irma Carillo Ramirez.

In one of the opposition, the American circle judge Andrew Oldham argued that the majority was guessing Trump’s behavior in foreign affairs and national security, areas in which the courts are granted the great president.

Oldham wrote: “The majority of the majority in this case is not only unprecedented, but also contradicts more than 200 years of precedents.”

The Trump administration won one legal victory in Tuesday’s decision, as the judges found the procedures used by officials to advise detainees under the Law of Foreign Enemies on their legal rights.

The ruling can be appealed to the full fifth circle or directly to the US Supreme Court, which is expected to make the final decision in this case.
