Court denies DOJ bid to block Kilmar Abrego Garcia’s return from El Salvador

On Thursday, the Federal Court of Appeal rejected the emergency request for the Trump administration to prevent the order of the judge who requires the United States government to return Kilmar Abrago Garcia, an illegal immigrant from El Salvador with a violent criminal history and alleged gang relations, was deported to the Salvadwan Mega prison (CECOT) last month.

The ruling is allowed to order the minimum to move forward at the present time.

The case includes Abyerigo Garcia, “Maryland’s man” who was deported, but his return was requested by the provincial judge after the Supreme Court’s decision recently. The Ministry of Justice (Doj) asked the American Court of Appeal from the fourth district to raise the order of the judge to “facilitate” the return of Abu Garcia from CECOT, but on Thursday the court rejected the request.

Among the three committee is the judges of Judge Harvey Wilkenson, who was appointed by president Ronald Reagan, alongside judges Robert King and Stephanie Thaker, who were appointed by presidents Bill Clinton and Barack Obama, respectively.

In the opinion of the court, Wilkinson has repeatedly referred to Aberigo Garcia as a “resident”, although Aberigo Garcia is not a resident in the United States.

“The government affirms the right to get rid of the population of this country in foreign prisons without the similarity of the due legal procedures that are the basis of our constitutional system,” Wilkenson wrote.

“This must be horrific not only for judges, but to the intuitive feeling of freedom that the Americans are still far from the courts are still dear.”

Court documents and police records show that Abigo Garcia has a history of domestic violence, including frequent physical abuse against his wife. The Ministry of Internal Security (DHS) was also defined as a member of the MS-13 gang, using the “Chele” street name.

The court said that the request of the Ministry of Justice was “unusual and intelligent” and that it would not interfere with the efforts of the provincial judge to implement the Supreme Court’s decision.

Public Prosecutor Bam Bondi said that Alago Garcia would not be allowed to return to the United States unless Al Salvador decides otherwise. “He will not return to our country.”

The Ministry of Justice did not immediately respond to the Fox News Digital request for comment.
