According to TMZ, the 48-year-old was taken into custody by the U.S. Border Patrol on Sunday in connection with the arrest of a fugitive linked to an out-of-state felony charge. Additionally, the California Penal Code cited in the case allows officers to make an arrest without a warrant if they believe the person is a fugitive wanted in another state. McCrary remains behind bars in San Diego with no bail or release in sight, according to court records. His team told TMZ that the arrest stems from a bench warrant issued out of Michigan after he allegedly missed a court date due to failure to pay child support.

A representative for McCrary responded to the arrest in a statement. They told Us Weekly that the actor was arrested at the border because “He was partnered with a real estate developer who was building homes for the homeless in Tijuana, Mexico.

“Darius was doing well when he discovered he had a felony warrant at the Mexico border for missing court,” the statement read. “The missed court appearance was due to an ongoing child support dispute, where Oakland County mailed a Notice to Appear to Darius’ PO box giving him only 3 days to appear in Michigan court. Unfortunately, Darius tested positive for COVID, so he did not check his PO until the day after the court date. However, the judge immediately reported the doctor’s note diagnosis of COVID.”
