Federal judge orders Trump administration to return a second deported immigrant

The second American judge in Maryland ordered the Trump administration to return another man who was deported from the United States to El Salvador last month under the law of foreign enemies-the latest case in a high-level legal battle in federal courts throughout the country.

The American boycott judge, Stephanie Gallagher, one of the appointed Trump, ruled on Wednesday that the Trump administration violated a settlement agreement reached by the Ministry of Public Security last year with a group of young asylum seekers when it deported a 20 -year -old man, and is indicated in the court files as “Christian”, to El Salvador last month.

It was part of a group of immigrants who illegally entered the United States as children who are not accompanied, and who later subsequently submitted asylum calls to stay in the United States

DHS agreed to the settlement that it will refrain from deporting any of the individuals in the classroom so that their asylum claims can be fully decided by an American court.

Gallaghar spent that the government had violated this agreement when it deported Christian, a member of the separation, and ordered that he be returned to the United States

The news of the case and settlement concerned was first reported by ABC News.

In her decision, Gallagr emphasized that, contrary to the other challenges in the court to deport Trump under the law of foreign enemies, this focuses on “violating the contract” by the government.

Her ruling also referred to the deportation of Abo Garcia, an alleged MS-13 member who lives in Maryland, who was deported to El Salvador last month. US officials resisted the court’s orders to facilitate his return to the United States

In response, Gallaghar specifically assigned the Trump administration in its decision to “submit a good -intention request to the El Salvador government and the release of Christian’s custody to the United States to the United States to await the dismissal of his asylum application on the basis of the front foundations.”

Meanwhile, the Trump administration told the court that it decided that Christian was eligible to remove under the law of foreign enemies because he was arrested and convicted of possession of cocaine earlier this year.

They told the court that his appointment as “a foreign enemy pursuant to AEA results in a stop being a member” in the chapter, which negotiated a settlement.

This agreement does not seem to keep water with Gallaghar, who ordered the government not to remove any other members in the separation until their asylum claims are properly decided.

“Therefore, according to the simple conditions of the settlement agreement and the basic principles of the contract law, the removal of the United States for a member, including but not limited to, Christian, without final determination on the benefits of the United States of America on the request for an asylum suspended for a separation member, violates the settlement agreement.”

It also granted a temporary restriction to another chapter, referred to as 18 years old as Javier, who said the group’s lawyer was an “imminent danger” to deport earlier this month, as ABC said.
