Michigan judge strikes down 24-hour abortion waiting period as unconstitutional

Michigan’s judge spent on Tuesday that the waiting period for 24 hours in the state and enlightened approval rules that restrict abortion were unconstitutional.
The waiting period, which allows abortion students to consider their options before the procedure, was voted in the state constitution by the Michigan voters in 2022, before a lawsuit was appealed in 2024 that was filed by abortion rights groups.
The state court wrote from a judge, especially in her opinion, “The mandatory delay exacerbates the burdens that patients suffer to obtain abortion care, including the increasing costs, prolong waiting times, and an increase in the risk that the patient must detect their decision to others, and the patient may be forced to abandon drug abortion of more risk procedures.”

The governor of Michigan Gretchen and who is in a post on X said it was “overwhelmingly” with the decision.
He wrote: “I felt overwhelmed to say that the court of claims in Michigan has witnessed these restricted rulings of what it is: an unconstitutional skipping violating our constitutional right to make our reproductive health decisions.” “Today’s ruling confirms what we already know: Reproductive health decisions belong between a patient and their doctor, and not the government. I am proud to know that this week of women’s health, we can celebrate by protecting and expanding the basic rights and freedoms of women.”

The head of the Michigan Catholic Conference and Executive Director Paul Long said that the intention of the proposal is to grant constitutional protection to “an industry that places itself above the health and safety of women and the lives of children born before born.”
“This decision is a tragic reminder that the normalization of abortion in Michigan is at the expense of about 31,000 children every year, they will not have the opportunity to try a gift and blessings of life,” Long wrote in a statement. “Now, more than ever, we encourage others to imagine a world in which human life is at every stage – from pregnancy to a normal end – is truly cherished and protected, as mothers are supported by expectations of love, care and access to the needs of the mother, regardless of the circumstance of pregnancy.”
