New York’s top court strikes down law allowing noncitizens to vote

The New York Court, the highest court in the state, prevented a law on Thursday, allowing non -citizens to vote in the local elections.

A former New York City Council member responded to the ruling by saying that it should have been a “open and closed issue” and that the law was “embarrassing”.

In one of the centers presented by New York City lawyers, the city said that non -American citizens constitute about a third of the city’s adults.

The near consensus, 6-1, is prohibited in 2021 by the Democratic City Council in New York City, which would make nearly a million non-employees qualified to vote in the municipal elections, including the mayor and the city council.

Those who argue in favor of the law claimed that a ruling on the New York Constitution on the qualifications of voters only guarantees the right of citizens over the age of 18 to vote with no denial of this right to non -employees.

Judges Rowan Wilson wrote in a decision that the New York State Constitution clearly shows that citizens alone are qualified to vote.

Wilson wrote that, under the logic of the appellants, the municipalities will be “free to enact legislation that would enable anyone to vote-including … 13-year-old children.”

“The New York Constitution, as stands today, draws a fixed line that restricts voting for citizens,” he said. “It is easy for the language and restrictions mentioned in that” the citizen “is not intended as a floor, but as a condition for the eligibility of the voters: the concession extends only to the citizens who were established by the right to vote through the appropriate proofs.”

“The state constitution and laws are clearly written in a clear language,” Joe Borielli, one of the case prosecutors and former New York City Council member who voted against the law, told Fox News Digital.

“This has always been an open and closed issue, and it is embarrassing that the city council fought hard to avoid the law, undermine the constitution, and weaken the votes of citizens,” he said.

The verdict supports a former decision by a lower court to nullify the law. The assistant judge Jenny Rivera was the only member of the opposition court.
