Al -Salvadori immigrant lawyers, Kilmar Abrago Garcia, asked a federal judge in Nashville on Tuesday to reject a criminal case against him, on the pretext that the indictment filed by the Trump administration amounts to “criticism” and selective trial.
The 35 -page deposit was provided on Tuesday to the American boycott judge, Verley Krincho, in the central region of Tennessee. This comes just two days before the release of Abrego Garcia on Friday from the federal seizure, as he was arrested on charges of human smuggling in May, immediately after returning to the United States from El Salvador at the end of a months -old judicial battle.
Kringso and American Judge Barbara Holmes decided that Abigo Garcia was eligible to release him from the criminal custody awaiting trial, although Holmes agreed to release him for 30 days, at the request of Abrego Garcia Attorney, who indicated fears that he would be deduced and photographed immediately.
For his part, Krenchu said in a 37 -page decision that the Ministry of Justice “fails to provide any evidence of something in the history of Abigo, or its displayed characteristics, which require detention.”

Cold water was also poured into the repeated government’s allegations that Abyerigo Garcia is a member of the MS-13 gang, an idea that he described as “fictional”.
It is not clear whether Crenshaw will intervene and give the removal proposal, late on Tuesday.
However, it comes at a time when the case of Abeerigo Garcia remained in the center of the legal Milstrom for months, a case that critics have allowed the Trump administration to test it imposed on the enforcement of immigration and its ability to slow down or avoid compliance with federal courts.
The request of the Intro Garcia lawyers directly focuses on the criminal indictment and investigations brought in the central region of Tennessee, which stems from the 2022 traffic station in the state.
His lawyers argued on Tuesday that the timetable for investigation and incitement shows the “severe lengths” to which the administration went to “bring a criminal case” against their client.
But the case of Abu Garcia is very complicated, which involves fencing, but it is an incomparable civil and criminal issue that has played for more than six months in separate federal courts, via two continents, and in dozens of hearings before various judges.
Consequently, it will be fraught with any following steps in the case with a violent political reaction.
Indeed, on Friday, the main final dates in both civil and criminal cases that involve the Parisia of Paris will attend: His expected launch of the United States Crime in Nashville at the end of a 30 -day residence, will be called the restrictions imposed on his removal that was imposed on a separate court order submitted by the American boycott judge Paula Xinis in Maryland last month.
This requires his transfer from Nashville to the nearest detention facility in Maryland. The lawyers told the court that they were planning to accompany him via private security, amid concerns about compliance with the Trump administration, as his family’s lawyers confessed to Fox News Digital in an interview last month.
Shinis said in her order that ice officials were also asked to give Abrego Garcia for 72 hours a notification of the removal country before the departure procedures began.

The Intro Garcia case has prompted the launch of at least three government officials in the Ministry of Public Security and the Ministry of Justice, including the sudden resignation of Ben Sharrara, the former federal public prosecutor and former head of the Central Central District of Tennessee.
Sherradeer resigned from his post at the Ministry of Justice on the same day that the Ministry of Justice obtained the indictment against Abrago Garcia.
His lawyer has used the “Mary’s tricks” court this week to clarify, in accurate detail, the schedule of the civil lawsuit and the criminal investigation of the Ministry of Justice in Abyerigo Garcia, which started while he was still being held in El Salvador.
“Kilmar Abrago Garcia was distinguished by the United States government,” his lawyer said on Tuesday. “It is clear why.”
The new deposit, in diverse detail, tells the history of the Trump administration’s actions in the six-month-old legal epic from Abro Garcia, which spanned two continents and multiple federal courts-which makes his case among the most prominent battles in immigration so far in the second period of Trump.
In the removal proposal, Abrago Garcia’s lawyers during the timetable for his deportation from the United States in March, in the first wave of Trump from the deportation trips to El Salvador, in addition to his eventually returning. They detailed the timing when the Ministry of Justice began achieving it in Abyerigo Garcia, and when they obtained a federal indictment against him.
They argued that the timing indicates that the criminal case was submitted by the Trump administration “for reasonable reprisals”, and in his opinion, as a means of revenge after the Abo Garcia family filed a lawsuit in Maryland, which challenges his removal.

Abugo Garcia was returned to the United States in May – months after Shinis, Maryland’s judge who heads the civil case, the Trump administration ordered his return to the United States – a decision that supported the Supreme Court in April.
The lack of the government has pushed Xinis to threaten the procedures for potential contempt earlier this year.
Upon his return to the United States in May, Abyerigo Garcia was immediately slapped with two charges of human smuggling caused by the 2022 traffic station, prompting new concerns about the following steps for the government.
Chris Newman, a lawyer who represents the family of Abrago Garcia, said, ”
On Tuesday, the Abo Garcia lawyers indicated that, in their opinion, “the government did not respond to the symposium, or with any effort to fix its mistake, but with the challenge.”
His lawyers said in a file on Tuesday: “A group of senior officials in the United States has sought revenge: They have started a general campaign to punish Mr. Alago for their daring to fight, and reached its climax in the criminal investigation that led to the charges in this case.”
“Instead of reforming its mistake and returning Mr. Abrago to the United States, the government fought at every level of the federal court system. At every level, Mr. Abrago won,” they added. “This issue is caused by the concerted effort of the government to punish it for the presence of a boldness, instead of accepting brutal injustice.”
His Lawyer Krensu urged to move quickly to reject the indictment.
The proposal to reject the criminal case comes a few days ago that ABREGO Garcia is to be released from the federal reservation on Friday, after the American judge Barbara Holmes and Crenshaw agreed to grant the residency for a period of 30 days requested by the Abrego Garcia legal team.

Trump officials, for their part, said that they will immediately seek to take Abyerigo Garcia in an ice custody and start removal procedures to a third country. They told the Shinis Court last month that delivery is likely to happen at the Federal Detention Center, where it is currently being held.
In the deposit, the lawyers noticed the difficult burden of the defense, under the federal ruling of criminal procedures, in order for the court to reject an indictment based on a “selective or revenge” prosecution, and their file is required by Judge Crinko.
